This Privacy Notice (“Privacy Notice”) sets forth the policies and practices employed by Midwest Tape, LLC and its affiliates (collectively, “Midwest Tape,” “our,” “us,” and “we”) with respect to how we collect, use, and disclose any information associated with an identified or identifiable individual (“Personal Information”), as well as the rights and choices individuals have regarding such Personal Information. Midwest Tape, the owner and operator of https://www.hoopladigital.com (the “Website”) and applications used to access the Hoopla services and its content (the “Apps”), and all related services (collectively the “Services”), is a limited liability company formed under the laws of the State of Ohio.

1. What Information Do We Collect?

We collect the following categories of Personal Information about you:

Account Information, such as username, password, and your member/library card number, along with all other information we collect when you register for a User Account not listed in any other category. Your username, along with any descriptive, biographical, or other information shared in your user profile, may be made publicly available when you use certain features of the Website and Apps, including when you elect to display media from the Website or Apps on a screen or monitor that is visible to others. Please exercise caution when determining how you wish to be identified and the personal details you choose to share when using the Services.

Please note that the Services may link or integrate with third-party sites, services or apps. We are not responsible for protecting any information that you choose to share with third parties through the Services, nor are we responsible for the privacy or security policies or practices or the content of such third parties. Accordingly, we encourage you to review the privacy and security policies and terms of service of those third parties so that you understand how they collect, use, share and protect your information. Please exercise discretion when sharing Personal Information.

Identifying Information, such as first and last name, email address, or other unique identifiers (including digital identifiers and device identifiers).

Contact Information, such as your postal address, home and/or mobile phone number, or other communication details. This also includes social media account and profile information if you contact us through a social media platform, access your social media profiles through our Website or Apps, or mention Hoopla Digital on a publicly shared social media post.

Location Information, including IP-based geolocation data and, with your consent and based on your device permissions, Global Positioning System (GPS) data. When you access the Website or use the Apps or our Services, we automatically collect and process information about your general or precise location. We use various technologies to determine location, including IP address, GPS, Wi-Fi access points, and mobile towers.

Communications with us, such as when you contact our customer support by phone, email, or online chat, or when you respond to surveys or feedback requests. We collect the contents of all such communications, including any information you provide in communications with us, including via social media, e-mail, or our customer call center. We also collect details about the communications we send to you (e.g., emails, text messages, push notifications, messages within the Website or Apps) and data concerning your interactions with these communications.

Transaction Information, including details and activity regarding your User Account through which you access our Website, Apps, or Services, including your selection and usage of videos, eBooks, audio recordings, and other media.

Interests and Preferences, including information inferred from your Transaction Information, ratings and/or feedback you provide, and other interaction information.

Other Personal Details about you, including your date of birth, age, or gender. If you are a vendor, service provider, or employee of one of our partner institutions, we may also collect employment-related information such as your job title, department name, and business contact information.

Inferences about you and your use of the Website, Apps, and/or Services based on Personal Information we collect about you (e.g., preferred content based on your watch history) and on information provided by third parties.

Device Information about the equipment and network you use to access the Website, the Apps and/or the Services, such as your operating system version, device type, and the name of the mobile network you are using. Our system logs may record certain information about your visits to our Websites or use of our Apps, including the web request, Internet Protocol (“IP”) address, device and mobile ad identifiers, browser information, and other similar technical information. We may also collect device information from emails you send to or receive from us, which helps us track which emails are opened and which links are clicked by recipients. If you use your login information while connected to a Virtual Private Network, we may also collect that information.

Client and Log data. Technical details, including the IP address of your device, time zone, and operating system. We will also store your login information (registration date, date of last password change, date of last successful login), type, and version of your browser.

Usage Information about your activity on our Website and Apps, which includes a date and time stamp of each visit, banners or content that you clicked, your interaction with such banners, clickstream information, duration of your visit, and the order in which you engage with our content. Based on your interactions and usage of the Website and Apps, additional information that is generated as part of such usage, such as transaction information and time and location of transactions may also be collected.

Verification Information, including data we are required or entitled by applicable law to collect and process for authentication or identification, or for the verification of data we collect.

Sensitive Personal Information: We do not ask for, and you are not required to provide sensitive Personal Information as part of our operation of our Services. However, if you elect to submit such information to us, it will be subject to the permissive uses and restrictions set forth in this Privacy Notice. We do not require you to provide sensitive Personal Information in order to confirm your age or identity, as we are able to perform verification solely on the basis of non-sensitive Personal Information. Any sensitive Personal Information submitted as part of a verification process, such as government-issued ID, will be subject to the terms of this Privacy Notice.

Minors: Midwest Tape does not knowingly collect any Personal Information from children under the age of majority. If a parent or guardian believes that Midwest Tape has Personal Information of a child under the age of majority, please contact us immediately at privacy@hoopladigital.com. We will use our best efforts to promptly remove such information from our records and unsubscribe the child from any marketing lists.

2. Where Do We Collect Your Personal Information From?

We collect the Personal Information described in Section 1 in the following ways:

From You: We collect Personal Information from you when you voluntarily provide such information, such as when you contact us, register for access to our Website, Apps, or Services, browse or conduct searches on our Website or Apps, sign up for alerts or our newsletter, or use our Services. We collect the following categories of Personal Information directly from you: account information, identifying information, contact information, transaction information, interests and preferences, and other personal details. In the event we need to verify your age or identity, pursuant to a Hoopla Digital internal policy or a legal or contractual obligation, we will collect limited verification information from you solely for that purpose.

Automatically when You use Hoopla Digital: When you interact with the Website or Apps, we automatically collect the following categories of information: account information, transaction information, location information, communications, device information, client and log data, and usage information.

We use cookies, local browser storage, and similar technologies, including “web beacons,” “pixels,” or “tags” as part of our process for collecting data automatically. A “cookie” is a small amount of data a website operator, or a third party whose content is embedded in that website, may store in your web browser and that the website operator or, as applicable, the third party, can access when you visit the website. We may collect the following categories of Personal Information about you from these other sources: account information, identifying information, contact information, location information, transaction information, interests and preferences, inferences, other personal details, and device information, in each case as permitted by applicable law.

3. How Do We Use Your Personal Information?

We use your Personal Information in order to operate, provide, maintain, develop, and promote our Website, Apps, and Services, to communicate with you, and to protect our business, our employees, our customers, and you. We use the categories of Personal Information listed above for the following purposes:

To provide you with the Services: This includes the operation and maintenance of the Website, Apps, and other digital properties; creating your User Account, identifying you as a user of the Website or Apps, and customizing the Website and Apps to your User Account and preferences; and processing any borrows or other requests you make through the Website or Apps. To operate Hoopla Digital: This includes activities and processes necessary for the ongoing operation of our business, including conducting financial transactions, providing you with user support; complying with geographical restrictions and licensing rights and obligations; and other activities peripheral to providing the Website, the Apps, and the Services. We use the following categories of Personal Information for this purpose: account information, identifying information, location information, communications, transaction information, device information, client and log data, and usage information.

To communicate with you: This includes responding to your comments or inquiries and fulfilling your requests; providing you with user support; communicating about your User Account; and sending administrative communications, such as confirmation emails, technical notices, policy updates, and security alerts. We use the following categories of Personal Information for this purpose: account information, identifying information, contact information, communications, transaction information, device information, and usage information.

To send you marketing and/or promotions: This includes sending you promotional information, such as newsletters and advertisements, including information and advertisements from our affiliates and on behalf of our promotional and strategic partners; and notifying you of new information or services that may be of interest, including promotions, campaigns, programs, contests, or sweepstakes, where permitted by applicable law. For analytics, research, and product and Service improvements: This includes tracking and measuring the performance of the Website, Apps, Services, marketing communications, and other content; and performing quality control of our Website, Apps, and Services through analytics and market research, and to otherwise determine the effectiveness and improve the quality of our Website, Apps, and Services. We use the following categories of Personal Information for this purpose: account information, identifying information, contact information, location information, communications, inferences, device information, client and log data, and usage information.

For personalization and advertising: This includes our efforts to improve your experience on our Website, within our Apps, and with our Services by providing a personalized experience; and reviewing the effectiveness of our marketing and analyzing other general demographic trends. To ensure the security and integrity of the Services: This includes securing our systems and protecting our business, our employees, and you by preventing, detecting, investigating, and securing against unauthorized or illegal activity and other security-related technical issues. To comply with the law and enforce our Terms: This includes the use of Personal Information as we believe to be necessary or appropriate for certain essential purposes, including: meeting our legal or regulatory obligations, complying with valid legal process, and protecting rights, safety, and property; to detect, prevent, or investigate security incidents, data breaches, or fraud; to enforce our Terms of Service and all other applicable terms and policies; and for all other purposes requested or permitted by our users or other relevant individuals, such as Website visitors or users of our Apps. Use of AI and Automated Decision Making.

To the extent permitted by law, we may use Artificial Intelligence (“AI”), Machine Learning (“ML”), or Automated Decision Making (“ADM”) as part of our processes that use your Personal Information. Such uses include:

Personalization: We use AI technologies to analyze your preferences and behaviors to provide personalized content. This process helps us deliver a unique and enhanced experience based on your preferences and interests. This use of AI is for the following purposes: to provide you with the Services, and for personalization and advertising in accordance with applicable law.

Recommendations: We use AI technologies to analyze your preferences and behaviors to provide recommendations based on your unique personal profile. This allows us to deliver relevant information or suggestions (e.g., search results and interest-based recommendations) and determine the order of the content presented to the user. This use of AI is for the following purposes: to provide you with the Services, and for personalization and advertising.

Profiling and Automated Decision-Making: We do not engage in profiling or use automated processing or decision-making on your Personal Information for decisions that produce legal or similarly significant effects within the meaning of applicable U.S. privacy laws or the E.U. AI Act.

Vendor Use of AI: Our vendors and service providers may use techniques like AI and/or ML to help us improve our Website, Apps, and/or Services. When our service providers use such tools, it either: (1) still has a human being involved in the process, and thus is not fully automated; or (2) uses such tools in ways that do not have significant privacy implications (e.g., reordering how products might appear when you visit an online store) and does not produce any legal or similarly significant effects.

AI Model Training.

Hoopla Digital uses internally developed artificial intelligence models and systems as part of our Services. Our models may be trained using data from publicly available information, datasets obtained through commercial agreements with third parties, user-provided inputs and outputs (subject to your opt-out rights), and/or user feedback, where permitted by applicable law and consistent with contractual obligations and technical safeguards.

We may use your inputs and outputs to train our models and improve our Services where allowed by law, unless you opt out through your account settings or by contacting us at privacy@hoopladigital.com. Even if you opt out, we may use inputs and outputs for model improvement when your interactions are flagged for safety review and/or you have explicitly reported materials to us through our feedback mechanisms.

4. How and To Whom Do We Disclose Personal Information

We may disclose Personal Information in certain circumstances as part of our general business practices. This section discusses those circumstances.

Disclosures for Business Purposes

To the extent permitted by law, your Personal Information may be disclosed with the following categories of third parties:

Parent Companies and Affiliates. We may share Personal Information with a parent company, any subsidiaries, or other companies under a common control for the following purposes: to provide you with the Services, to operate Hoopla Digital, to communicate with you, to send you marketing and/or promotions, for analytics, research, and product and Service improvements, for personalization and advertising, to ensure the security and integrity of the Services, to comply with the law and enforce our Terms.

Corporate Transactions. If we sell or transfer all or a portion of our business assets, or in connection with a reorganization or restructuring, we may share Personal Information for the following purposes: to provide you with the Services, to operate Hoopla Digital, to communicate with you, to send you marketing and/or promotions, for analytics, research, and product and Service improvements, for personalization and advertising, to ensure the security and integrity of the Services, to comply with the law and enforce our Terms.

Agents, Consultants, and Related Third Parties. For business-related functions (such as mailings, database maintenance, and payment processing), to the extent such information is needed to perform their designated function, we may share Personal Information for the following purposes: to provide you with the Services, to operate Hoopla Digital, to communicate with you, for analytics, research, and product and Service improvements, for personalization and advertising, to ensure the security and integrity of the Services, to comply with the law and enforce our Terms.

When Legally Required. We may share Personal Information to comply with applicable law, regulations, legal process from courts and tribunals, requests from governmental or public bodies, and other third parties as we believe necessary or appropriate to protect people or property, to protect our services, rights or property, for the following purpose: to comply with the law and enforce our Terms.

Third Party Vendors and Service Providers. We share Personal Information with vendors and service providers who provide products and services related to the operation and maintenance of the Website or Apps, the performance of certain services, the analysis of user behavior, and to promote the Services and assess our promotional efforts. Our service providers may process your Personal Information, on our behalf and at our direction for the purposes described in this Privacy Notice, subject to contractual restrictions, safeguards consistent with applicable law, and their respective privacy notices, for the following purposes: to provide you with the Services, to operate Hoopla Digital, to communicate with you, to send you marketing and/or promotions, for analytics, research, and product and Service improvements, for personalization and advertising, to ensure the security and integrity of the Services, to comply with the law and enforce our Terms.

Hoopla Digital uses vendors and service providers for services including:

  • Tracking - To improve our Website, Apps, and Services, we may share your de-identified, anonymized, and/or aggregated information with analytics providers that help us analyze how people use our Services. For example, we utilize standard industry-wide analytics software to understand how people use our app, enabling us to improve the Services and increase engagement. We use the following third-party service providers for tracking:
  • Cloud Hosting & IT Infrastructure Providers – We utilize third-party vendors to provide hosting and storage of our data and systems. Personal information may be collected and maintained by third-party vendors as part of their provision of these services.
  • Remarketing – We utilize remarketing tracking cookies and conversion pixels to display targeted offers for our products and services to you across the web and various social media networks, where permitted by applicable law and subject to user choice mechanisms. This means that you may see an ad for one of our products or services after having visited our Website or having used one of our Apps. Midwest Tape also utilizes custom audiences based on user email addresses, enabling us to present targeted offers.
  • Surveys and Forms – Midwest Tape utilizes third-party services to create and manage online surveys and other forms, facilitating the collection and organization of information. Personal Information may be collected and maintained as a result of interacting with any surveys or forms.
  • Email Marketing/Newsletters – Midwest Tape uses email service and email marketing vendors. Through these vendors, we collect information related to our communication effectiveness and the impact of our email marketing, including tracking the actions you take that assist us in measuring the performance of our Services and email marketing.

    Upon subscription, our email marketing/newsletter vendors may track the pages you visit on the Website or the Apps. If you are or become a subscriber, information about your transactions is provided to these vendors to assist in this function.

    Our marketing emails contain tracking pixels, which enable us to analyze the effectiveness of our email marketing campaigns. These tracking pixels allow us to determine if and when you open an email, which links you click within the email, and which pages of the Website or the Apps you visit.

  • Push Notifications – Midwest Tape uses third-party vendors to deliver important updates and relevant information through push notifications. When users opt in to receive push notifications, the device ID is collected and shared with these vendors to enable the delivery of these notifications. Push notification preferences can be managed or unsubscribed from at any time through your device settings.
  • Online Contact and Support – We offer multiple ways for you to contact us, including contact forms, emails, live chat, and automated chat. We may use AI systems to provide some or all of these services to you. If you choose to contact us through a contact form, the information you provide will be stored by the vendor providing the service you use for such contact pursuant to that company’s Privacy Notice. We use vendors for the respective contact services listed below:
    • Contact Forms on the Website and Apps
    • Online Live Chat
    • Online Automated Chat
    • Email Service Provider
  • Social Media Content Curation – We use a third-party vendor to curate content from our social media platforms to use on the Website and Apps.
  • Customer Relationship Management (CRM) – We utilize CRM vendors to manage customer interactions and data for business relationship management purposes, which may be enriched or updated by the vendor to ensure accuracy and relevance.

Other Third Parties. We send your Personal Information to whom you ask us to send your information or with your consent.

Sale and “Sharing” of Personal Information

We do not sell your Personal Information to third parties in exchange for monetary compensation. However, we may disclose certain Personal Information to third parties, such as advertising technology partners, data analytics providers, social media platforms, and advertising networks, so that we can provide you with targeted advertising and measure and improve the effectiveness of our advertising campaigns. These third parties may receive other valuable consideration or benefit from the use of the disclosed information for their own purposes, such as improving or enhancing their own products, records, or services. Under certain U.S. privacy laws, these disclosures may constitute a “sale” or “sharing” of Personal Information as those terms are defined under the CCPA and other applicable U.S. state privacy laws.

Categories of Personal Information that may be disclosed in this manner include: identifiers and contact information; online and technical information, such as IP address, device identifiers, cookie identifiers, and information regarding your interaction with our Website, Apps, Services, or emails; commercial information, such as borrowing history; geolocation data; and inferences or profiles derived from the foregoing. We do not sell or share the Personal Information of consumers we know to be under 16 years of age unless we receive affirmative authorization as required by applicable law.

You have the right to opt out of such sales and sharing, as those terms are defined under applicable U.S. state privacy laws. We also honor browser-based opt-out preference signals, such as the Global Privacy Control ("GPC"), as required by applicable law.

Disclosure of Other Information

We may process and disclose information that does not identify you and is not associated with your Personal Information. We may also de-identify, anonymize, or aggregate information so it no longer identifies you.

Analysis of the Performance of the Website and Apps. We may use such information and pool it with other information to track, for example, the total number of visitors to our Website or users of our Apps, the number of visitors to each page of our Website or Apps, and the domain names of our visitors’ Internet service providers.

Customer Research. To better serve and understand the needs of the Website or Apps’ users, we may conduct research on its visitor demographics, interests, and behavior based on the Personal Information and other information provided to us.   • Legitimate Interest – processing your Personal Information in the interest of conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We balance the potential impact on you (both positive and negative) and your rights. If the impact on your rights outweighs our legitimate business interests, we do not use or disclose your Personal Information without your consent, unless we are otherwise required or permitted to do so by law. 5. Your Rights Related to Your Personal Information.

We provide several ways for you to exercise certain privacy choices regarding your Personal Information processed by us. We are committed to respecting your privacy rights under all applicable data protection and privacy laws. Some privacy laws require us to provide specific information about individual rights to consumers, which we have set forth in Section 10 of this Privacy Notice.

Marketing. You may opt out of marketing-related communications from us on a going-forward basis by contacting us at privacy@hoopladigital.com or by using the unsubscribe mechanism contained in each email. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt out.

Cookies Preferences. To review and update your preferences for most types of cookies (other than those that are strictly necessary) for our Services, click the “Cookie Preferences” link in the footer of the Website.

Location Information. You can choose whether or not to allow the Website or Apps to collect and use real-time information about your device's location through your device's privacy settings. If you block the use of location information, some parts of the Services may become inaccessible or not function properly. Deactivation. You can deactivate your User Account at any time by contacting us at privacy@hoopladigital.com or by selecting the “Deactivate My Account” option in your User Account. However, you will not be able to access any part of the Services that are for registered users only once your User Account is deactivated. Please note that it may take some time to fulfill this request.

Access, Amendment, and Deletion. Under applicable privacy laws, you may have the right to request to review, make amendments to, have deleted, or otherwise exercise your rights over your Personal Information that we hold, subject to certain legal limitations and requirements. We will process any request in accordance with – and where required by – applicable law with respect to your Personal Information. We will take steps to verify your identity before implementing your request. We do not charge a fee to process or respond to your verified consumer request unless it is excessive, repetitive, manifestly unfounded, otherwise creates a burden or workload in excess of standard requests, or is prohibited by law. If we determine that the request warrants a fee, we will inform you of our decision and provide both a written justification for the fee and a cost estimate before proceeding with your request.

If you have a User Account with us, you may also make specific changes directly through your User Account profile page. Please note that changes made to your User Account profile page may not be reflected immediately.

Although our active systems and databases will reflect updates that have been requested and processed, we may retain all Personal Information for backup purposes, archiving, fraud and abuse prevention, analytics, and to satisfy any legal obligations that we reasonably believe are applicable.

Time for Changes to Take Effect

We aim to complete requests as soon as reasonably practicable, consistent with applicable laws. Requests made on behalf of another, which require confirmation of the agent's authority and the authenticity of the requester, will likely take more time to complete.

Even after your Personal Information has been updated pursuant to a verified request, due to the size of our network, not all active systems may immediately reflect the updates.

We may need to retain certain information for recordkeeping purposes and/or to process actions or requests that you made before requesting a change or deletion. There may also be residual information that will remain within our databases and other records, which will not be removed.

We may periodically update this Privacy Notice. Please reference the “LAST UPDATED” legend at the top of this page to see when this Privacy Notice was last revised. Any changes to this Privacy Notice will take effect upon the posting of the revised Privacy Notice on the Website and Apps.

Your continued use of the Services will, along with express consent where required, constitute your consent to any additional processing of your Personal Information described in our then-current Privacy Notice.

7. Third Party Privacy Practices.

Our Services may contain links to third-party websites or apps. If you click on one of these links, please note that each such website or app may have its own privacy notice and/or terms of use. We do not control third-party websites and apps and are not responsible for such policies and terms. Hoopla Digital recognizes and responds to the Global Privacy Control ("GPC") opt-out preference signal, which is a browser-based signal that communicates your preference to opt out of the "sale," "sharing," and/or processing for purposes of targeted or cross-context behavioral advertising of your Personal Information, as those terms are defined under applicable laws. If our Website, Apps, and/or Services detect that your browser or device is transmitting a GPC signal, we will process that signal as an opt-out request for that browser or device in accordance with applicable law.

Reservation of Rights

Regardless of any other provision in this Privacy Notice, we reserve the right to disclose any personally identifiable or non-personally identifiable information about you where we determine in good faith that such disclosure is necessary or appropriate to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our Website, our Apps, or other users; or (d) protect the health and safety of our customers or the general public. This may include exchanging information with third parties and organizations to reduce credit risk and protect against fraud.

Security of Personal Information

We use standard physical, technical, and administrative measures designed to reduce the risk of loss, misuse, unauthorized access, disclosure, or modification of your Personal Information. Unfortunately, no system or network can be guaranteed to be 100% secure. Accordingly, we cannot and do not guarantee the security of information. Where you have a password to access certain parts of our Services, you are responsible for keeping this password confidential. Please do not share your password with anyone.

Retention of Personal Information

We retain each category of Personal Information for only as long as necessary to fulfill the purposes described in this Privacy Notice or as otherwise required or permitted by applicable law. We consider the amount, nature, and sensitivity of the Personal Information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we process it and whether those purposes can be achieved through other means; and any relevant legal, regulatory, tax, accounting, or reporting requirements.

Residents of certain countries or U.S. states may have additional rights under applicable privacy laws. The term “Personal Information” encompasses “Personal Information” as defined by the applicable jurisdiction’s law.

10.1 California

CCPA Personal Information Use Disclosure

The California Consumer Privacy Act of 2019 (“CCPA”) requires that we disclose certain categories of Personal Information that we collect, the sources of that Personal Information, the purpose of collecting such information, and the categories of third parties with whom we share that information.

Categories of Personal Information that we collect and disclose. Our collection, use, and disclosure of Personal Information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such resident. Below, we describe the categories of Personal Information we may collect about California residents (including the categories of Personal Information that we have collected about California residents in the past 12 months):

  • Identifiers: including direct identifiers such as a real names, aliases, addresses, unique personal identifiers, online identifiers, Internet Protocol (IP) addresses, email addresses, account names, or other similar identifiers.
  • Customer records: paper and electronic customer or user records containing Personal Information, which You provide to us, such as your name, digital signature, address, telephone number, email address, other contact information, , cardholder data, and similar information.
  • Usage data: internet or other electronic network activity information, including, without limitation, browsing history, search history, and information regarding a consumer’s interaction with an Internet website, application, or advertisement.
  • Location data: location information about a particular individual or device.
  • Profiles and inferences: inferences drawn from any of the information identified above to create a profile reflecting a resident’s preferences, or characteristics.
  • Sensitive Personal Information: in limited circumstances, we may collect certain information considered to be sensitive Personal Information under the CCPA, including geolocation data.

We may disclose any of the categories of Personal Information we collect about you to other third parties for business purposes or as directed by or consented to by you, or where necessary to fulfill your specific requests.

Sales and Sharing. The CCPA defines a “sale” as disclosing or making available Personal Information to a third party in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available Personal Information to a third party for cross-context behavioral advertising. While we do not disclose Personal Information to third parties in exchange for monetary compensation, we may “sell” or “share” (as those terms are defined by the CCPA), where permitted by law and subject to user opt‑out rights: (i) identifiers, usage data, customer records, commercial information and profiles with our affiliates and subsidiary companies; (ii) identifiers and customer records with partners and third party businesses, who may use or process the information for their own commercial purposes; and (iii) identifiers, usage data and commercial information to ad networks, social media platforms and data analytics providers (e.g., to improve and measure our ad and marketing campaigns).

As described in more detail in Section 3, above, we collect, use, disclose, and otherwise process Personal Information (including sensitive Personal Information) for the following business or commercial purposes or as otherwise directed or consented to by you:

Certain information is exempt from such requests under applicable law. You may also have the right to receive information about the financial incentives we offer you (if any). You also have certain rights under the CCPA not to be subject to negative consequences for exercising your CCPA rights.

Minors. We do not knowingly sell or share Personal Information of consumers under 16 years of age. If we become aware that a consumer is between 13 and 16 years old, we will obtain that consumer’s affirmative authorization (opt-in) before any sale or sharing. For consumers under 13, we will obtain parental/guardian consent.

Submitting CCPA Requests. California residents may exercise their CCPA privacy rights to know, access, delete, correct, and limit use/disclosure of sensitive Personal Information by submitting a verifiable request to us via:

We will respond to verified requests received from California residents as required by law. When you submit a request to know or a request to delete, we will take steps to verify your identity by matching the information you provide with the information we have in our records. You must provide all requested information so that we can process and verify your request. In some cases, we may request additional information to verify your request or, as necessary, to process it. If we are unable to verify a request, we will notify the requester. Authorized agents may initiate a request on behalf of another individual by contacting us via email or phone. To do so, they will be required to provide proof of their authorization. Additionally, we may also require the relevant consumer to directly verify their identity and the authority of the authorized agent.

Rights Under California Shine the Light Law. California residents may request from businesses with whom they have an established business relationship: (1) a list of categories of Personal Information, such as name, address, e-mail address, and the type of services provided to the customer, that a business has disclosed to third parties during the immediately preceding calendar year for the third parties’ direct marketing purposes and (2) the names and addresses of all such third parties. 10.2 Other U.S. States

Nevada provides its residents with a limited right to opt out of the sale of certain Personal Information. However, please note that we do not currently sell data that triggers the statute's opt out requirements.

10.3 Residents of Canada

Canadian privacy laws, including the Federal Personal Information Protection and Electronic Documents Act (“PIPEDA”), the Personal Information Protection Act, SBC 2003 c 63, in British Columbia, the Personal Information Protection Act, SA 2003 c P-6.5, in Alberta, and the Act Respecting the Protection of Personal Information in the Private Sector, CQLR c P-39-1 (“Quebec Private Sector Act”), in Quebec, apply to the collection of Personal Information from and about Canadian residents. “Personal Information,” as used in this Privacy Notice, includes “personal information” as defined under those laws.

Midwest Tape’s Privacy Officer is the person in charge of Personal Information, including under the Quebec Private Sector Act. You may contact them via email at privacy@hoopladigital.com. When Midwest Tape collects Personal Information belonging to Canadian residents (including those in Quebec), it transfers some of that data to data centers in the United States and/or to other foreign jurisdictions with similar privacy protections. When Midwest Tape relies on service providers to process Personal Information as described herein, those service providers may also be located outside of Canada or Quebec.

You have the right to request access or rectification of the Personal Information Midwest Tape holds related to you or to withdraw any consent given to the processing of such Personal Information. You may exercise those rights by contacting Midwest Tape’s Privacy Officer at privacy@hoopladigital.com. If Midwest Tape is in possession of your Personal Information that was originally collected with your consent by an entity that subsequently provided it to Midwest Tape, please contact that entity for any questions related to that entity’s privacy policies and consent practices.

10.4 Australia

Australian privacy laws and regulations, including the Australian Privacy Principles and the Privacy Act of 1988 provide certain rights to qualifying individuals, and for those individuals if there is any conflict between this addendum and our global Privacy Notice, this Section 10.4 prevails.

Collection and security of Personal Information

We take reasonable steps to ensure that Personal Information is accurate, and we apply safeguards that are proportionate to the risk. Personal Information is retained only as long as required for lawful purposes, after which it is securely disposed of, de-identified, or aggregated.

In the event of a privacy breach that is likely to cause serious harm, we will notify affected individuals and the Office of the Privacy Commissioner and take all other steps as required by law.

Direct Messaging

Our commercial electronic messages clearly identify us and include an easy-to-use unsubscribe option, as required by the Unsolicited Electronic Messages Act of 2007.

You may always manage your individual user marketing and personalization settings in your User Account settings. You may report concerns to the Department of Internal Affairs.

Cross-Border Transfers

We only disclose Personal Information to recipients outside New Zealand when comparable privacy safeguards apply (e.g., enforceable contractual obligations) or another exception under IPP 12 applies.

Access & Correction

You may request access to and correction of any Personal Information we hold about you. If we do not agree to a correction, you may request that a statement of correction be attached. We assign unique identifiers only where necessary and do not require you to use another agency’s identifier except where permitted by law.
